First line in code snippet to add device causing errors

As I understand it from talking to Rafey, if the OS is already up to date, the first line throws an error and stops the process. The dev then has to start troubleshooting. How can we prevent this error?

If the OS is a Debian container running in Docker then an additional apt-get update is required before running apt-get install.

Using the command sudo apt-get install -y curl gave me this error. What my assumption is that the apt packet management tool was being used by something else because restarting my EC2 instance fixed the problem.
